Litigation (top)



Part I

This course will introduce the Civil Litigation process and develop an understanding of the law of civil litigation in New York from case inception to motions.

The concepts of jurisdiction, venue and statutes of limitations, pleadings, bills of particulars, motion practice and discovery documents will be explored. Practical exercises and standard forms will be provided.

Part II

The course will define the role of the Legal Nurse Consultant in Medical Malpractice / Personal Injury plaintiff and/or defense litigation.

All aspects of the litigation will be covered from commencement of lawsuit to judgment with special emphasis on the nature and extent of injury; adequacy and care of treatment; review of medical records and diagnostic tests; identification and preparation of experts and independent medical reviews.

Identify duty, breach, proximate causation and damages, elements of negligence and medical malpractice law. Utilize the elements in dissecting medical records and identifying pertinent objective data. Computers and the Law (top)



To ensure that every student understands the fundamental concepts and mechanics of computer use, this course examines the basics of operating systems and several types of application software. The function of generic application software (word processing, electronic spreadsheet and database) are integrated into specific programs used in most law offices: accounting, time and billing, calendaring, desktop publishing, document generation, forms and case management are examined. Students are instructed in the essentials of computer-assisted legal research (CALR), using Lexis and Westlaw. The most prominent feature of this course is its extensive "Hands-On" tutorials for WordPerfect and the on-line databases. This tutorial is very detailed and supports both the beginner and the more advanced student.
